1. Scope
1.1 Parties to the contract and subject matter of the contract
The General Terms and Conditions below form the contract between you
as a user and us, Esperado Media AB (hereinafter referred to as "us"
or "we"). The subject matter of this contract is the use, under any
form, or version, of the services under the name BeStrongr via our
website www.bestrongr.com, other BeStrongr websites or software
applications and apps (hereinafter referred to as 'BeStrongr
Services' or in general 'BeStrongr').
1.2 Terms and conditions for participating
A condition for opening a user account and using the BeStrongr
Services is that you are at least 18 years of age and have full
legal capacity. Use of BeStrongr for commercial purposes of any
kind, without the written conscent of us, is prohibited.
1.3 Beta version of the service
The BeStrongr service is under Beta testing and during this period
the terms and conditions are kept to a minimum. When the 1.0 version
will be released all of the current users must accept the updated
terms before continuing to use the service.
1.4 Additional terms and conditions
We reserve the right to agree to additional terms and conditions for
BeStrongr Services. We will notify you of this prior to use.
2 . Health
2.1 Terms and conditions with regard to your health
Use of the BeStrongrs Services is at your own risk.
The BeStrongrs Services must only be used if you are in a good
general state of health. If you have any pre-existing medical
conditions, such as but not limited to cardiovascular, lung,
respiratory, spinal or neuromuscular, we strongly advise you to seek
medical advice from a doctor before you start using any of the
BeStrongrs Services. You are also responsible for verifying that the
foods and nutrients recommended as part of any coaching or guide do
not contain any ingredients or contents to which you are allergic or
which may cause food intolerance.
Pregnant and/ or breast-feeding women should not use the BeStrongr
Services.
If you during a BeStrongr Exercise are feeling dizzy or ill, abort
the exercise at once and contact your doctor for consultation.
2.2 No substitute for medical advice
The services and information offered by BeStrongr and the BeStrongrs
Services do not constitute medical advice or a doctor's advice. Nor
are they a substitute for a medical examination or treatment by a
doctor.
2.3 Training Methods
The BeStrongr team is constantly evolving the training practices and
advises within the service, based on any common knowledge at that
time. The advises should always be seen as part of a broader
spectrum of advises that you as a user of the service can get hold
of from other parties.
3. Services and Prices
3.1 Services free of charge or for a fee
The scope of the services included in the Bestrongr Services and
available for use by you depends on the type of Bestrongr Service
and whether you use the Bestrongr Services free of charge or for a
fee. If you use it free of charge you only have access to certain
basic functions and information of the respective Bestrongr Service.
A more extensive range of functions is available to you if you
enable the respective content modules such as subscribing to a
training group or a one-off payment for a training program.
Please note that in order to use some of the Bestrongr Services to
the full extent, certain equipment and training tools may be
required. These are not part of the Bestrongr Services and need to
be provided or purchased by you separately at your own costs.
3.2 Prices
Please consult the webapp app.bestrongr.com/ for information on the
respective current pricing and subscription models and the services
that these include. All prices stated include the applicable VAT.
4. Execution and validity of contract
4.1 User contract
The user contract concluded between you and us is valid when you are
starting to use our services and thereafter for an indefinite
period.
5. Termination of contract
5.1 Termination
We reserve the right to terminate any contract and cancel any user
of the BeStrongr Services for any reason at any time without any
prior notice. Such termination does not give the user any right to
compensation.
6. Liability
6.1 General
BeStrongr does not take any responsibility for the use of the
service. Furthermore we do not take any liability in any third party
claims on the service.
6.2 User generated content
Any content uploaded or in any other way provided to the BeStrongr
service is under the responsibility of the uploader or provider.
BeStrongr accept no liability for such content and we do not monitor
user generated content.
7. Jurisdiction
6.1 Place of jurisdiction
Jurisdiction for all disputes arising from this contract is
Sweden.
